Stream 0 substances in the Petroleum Sector Stream Approach

Stream 0 substances under the Petroleum Sector Stream Approach are not produced by the petroleum sector. They were identified during the initial triage because they arise from processes that are similar to those used in the petroleum sector and are considered to be of unknown or variable composition, complex reaction products or biological materials (UVCBs). Regulations

Proposed Certain Products Containing Toxic Substances Regulations

In November 2023, the proposed Certain Products Containing Toxic Substances Regulations were published for a 70-day public comment period. The proposed Regulations would prohibit the manufacture, import, and sale of certain coal tar-based sealant products and certain sealant products containing PAH levels above 1,000 parts per million.

Comments and information received during the public comment period will be considered in the development of the final regulations.

Section 71 Chemicals Management Plan 2023

In June 2023, a notice was published in the Canada Gazette, Part I: Vol. 157, No. 25 – June 24, 2023 under section 71 of the Canadian Environmental Protection Act, 1999 (CEPA 1999). This notice applies to CAS RN 8007-45-2. More information is available on the Information gathering with respect to certain substances under the Chemicals Management Plan web page.

2018 Mandatory survey - section 71 notice

In December 2018, a notice was issued in the Canada Gazette, Part I: Vol. 152, No. 48 - December 1, 2018, under section 71 of CEPA 1999 in regards to coal tars and their distillates. The notice included 6 substances in this stream. Information received through this notice was used to inform risk management activities for these substances.

Proposed regulations for Polycyclic Aromatic Hydrocarbons (PAHs) in sealant products

In August 2022, a Proposed regulations for Polycyclic Aromatic Hydrocarbons (PAHs) in sealant products: consultation document  was published for a 60-day consultation period. The purpose of this consultation was to complement the consultation document on the proposed Regulations for Coal Tar-based Sealant Products by informing stakeholders and soliciting feedback on the key elements to regulate PAHs in pavement and roofing sealant products, in addition to coal tars and their distillates.

Comments and information received during the consultation were considered in the development of the proposed Regulations.

The purpose of this consultation was to inform stakeholders and solicit feedback on the key elements of proposed regulations for coal tar-based sealant products.

Coal tars and their distillates are proposed to be added to Schedule 1.

Final screening assessment and risk management approach

Coal tars and their distillates

In June 2021, the Final Screening Assessment for Coal Tars and their Distillates was released and the related notice was published in the Canada Gazette, Part I: Vol. 155, No. 26 – June 26, 2021. The conclusions of the assessment are considered to cover all coal tars and their distillates, including but not limited to the 6 substances specifically identified in the assessment.

The final screening assessment concluded that coal tars and their distillates meet 1 or more criteria set out in section 64 of CEPA 1999; therefore, the Government is proposing to add these substances to Schedule 1 to the Act. A proposed risk management approach was also released on this date for a 60-day public comment period.

In June 2016, the Draft Screening Assessment for Coal tars and their Distillates was released and the related notice was published in the Canada Gazette, Part I: Vol. 150, No. 24 - June 11, 2016. A risk management scope was also released in conjunction with this publication. There was a 60-day public comment period associated with these publications.
