Chemical Substances in Batch 10 of the Challenge

Update on Batch 10

New information was received from the public, including industry or other interested stakeholders, for each of the 12 substances in Batch 10 of the Challenge and the additional Cobalt sulfate (CAS No. 10393-49-4), which was added to the Notice with respect to Batch 10 Challenge substances. All information that was received in purported compliance with a Notice issued under section 71, or in response to a voluntary questionnaire and the substance profiles for Batch 10 substances, has been considered in the preparation of draft screening assessments and risk management scope documents for these substances.

Draft Screening Assessments for Batch 10 Substances

(Public comment period June 26, 2010 to August 25, 2010)

On June 26, 2010, seven Notices relating to the release of draft screening assessments for the 12 substances in Batch 10 of the Challenge, together with the additional Cobalt sulfate (CAS No. 10393-49-4) included for substance identification purposes, were published in the Canada Gazette Part I, Vol. 144 No. 26 and the draft screening assessments were released on this web site (see below).

There is a 60-day public comment period associated with these publications. Public comments may be submitted (from June 26, 2010 to August 25, 2010) on (a) the draft screening assessments and (b) the proposal to pursue one of the measures as specified under the Canadian Environmental Protection Act, 1999 (CEPA 1999). Details on how to submit public comments can be found within the applicable Canada Gazette Notices for each substance in the tables below. Please note that the public comment period will not be extended. Given the Government's commitment to finalizing the screening assessments by the deadlines specified below, any information received after the end of the public comment period may not be taken into consideration in the final assessment report.

Risk Management Scope Document for a Batch 10 Substance

(Public comment period June 26, 2010 to August 25, 2010)

Under the Chemicals Management Plan's Challenge, the Government of Canada has committed from the outset to engaging members of the public on the proposed management of the risks associated with substances in the Challenge. When the proposed conclusion of the draft screening assessment report is that a substance meets one or more of the criteria set out under section 64 of the Canadian Environmental Protection Act, 1999 (CEPA 1999), an accompanying risk management scope document is available to the public for a 60-day comment period. Please note that the public comment period will not be extended.

The risk management scope document is a preliminary outline of the options being examined for the management of a substance based on the proposed conclusions of the draft screening assessment report. Members of the public, including industry and other interested stakeholders, are being invited to submit comments on the content of the risk management scope documents or to provide other information that would help inform decision-making. Comments submitted on the Batch 10 risk management scope document, from June 26, 2010 to August 25, 2010, will be taken into consideration as the Government of Canada moves forward with the development of a risk management approach document.

The proposed risk management approach document will be a more detailed document building on the risk management scope document that outlines, in more depth, the proposed risk management actions, including the proposed choice of instrument or tool. The release of the proposed risk management approach document will coincide with the publication of the final screening assessment report, anticipated on December 25, 2010. The proposed risk management approach document will also be subject to a 60-day public comment period.

Comments and information submissions on the risk management scope document should be submitted via the Substances Management Information Line.

Notice of Intent to Amend the Domestic Substances List to Use the Significant New Activity Provisions of the Canadian Environmental Protection Act, 1999 in Relation to a Batch 10 Substance

(Public comment period June 26, 2010 to August 25, 2010)

For two substances in Batch 10 (CAS No. 124751-15-1 and CAS No 42739-61-7), the proposed conclusion of the draft screening assessment is that these substances do not meet the criteria set out in section 64 of the Canadian Environmental Protection Act, 1999 (CEPA 1999).

However, while [Resin acids and Rosin acids fumarated barium salts] (CAS No. 124751-15-1) is not believed to be in commerce and is not believed to be entering the environment, there is concern that new activities for this substance which have not been identified or assessed under CEPA 1999 could lead to this substance meeting the criteria set out in section 64 of the Act. Therefore, it was recommended that this substance be subject to the Significant New Activity (SNAc) provisions specified under subsection 81(3) of the Act, so that any new manufacture or use of this substance is notified and will undergo ecological and human health risk assessments as specified in section 83 of the Act prior to the substance being introduced into Canada.

While Nickel, bis[2,3-bis(hydroxyimino)-N-(2-methoxyphenyl)butanamidato]- (CAS No. 42739-61-7) does not meet the criteria set out under section 64, given its hazardous properties, there is a concern that new activities for this substance, which have not been identified or assessed under CEPA 1999, could lead to this substance meeting the criteria set out in section 64 of the Act. Therefore, it is recommended to amend the Domestic Substances List (DSL), under subsection 87(3) of the Act, to indicate that subsection 81(3) of the Act applies with respect to this substance so that any new manufacture or use of this substance is notified and undergoes ecological and human health risk assessment.

A Notice of intent to amend the Domestic Substances List under subsection 87(3) of CEPA 1999 to indicate that subsection 81(3) of the Act applies with respect to [Resin acids and Rosin acids, fumarated, barium salts] was published in the Canada Gazette Vol. 144, No. 26 on June 26, 2010.

There is a 60-day public comment period (from June 26, 2010 to August 25, 2010) associated with this Canada Gazette Notice. Details on how to submit public comments can be found within the Notice.

Another Notice of intent to amend the Domestic Substances List under subsection 87(3) of CEPA 1999 to indicate that subsection 81(3) of the Act applies with respect to Nickel, bis[2,3-bis(hydroxyimino)-N-(2-methoxyphenyl)butanamidato]- will be published in the Canada Gazette, Part I, at the same time as the final assessment report.

Background

Launch of Batch 10

On June 20, 2009, the Minister of the Environment and the Minister of Health released a Notice in the Canada Gazette for the tenth group of substances identified under the Challenge, entitled: Notice of tenth release of technical information relevant to substances identified in the Challenge. Members of the public, including industry and interested stakeholders, were asked to submit information (by responding to a mandatory survey notice, if applicable, and/or a voluntary questionnaire) that could be used to inform risk assessment and to develop and benchmark best practices for risk management and product stewardship.

In order to gather information on these Batch 10 Challenge substances from industry and interested stakeholders, a mandatory survey notice was issued under section 71 of the Canadian Environmental Protection Act, 1999 (CEPA 1999). This Notice applied to the 12 substances in Batch 10 of the Challenge.

Industry and interested stakeholders were also invited to complete a voluntary questionnaire or to submit a Declaration of Stakeholder Interest.

In addition, Environment Canada and Health Canada released "substance profiles" for each of these substances, summarizing the scientific information and any relevant uncertainties and specifying the information necessary for improved decision-making.
